Separation

Our experienced Family Law team offer a comprehensive service to clients who find themselves in a situation where they face a separation. Separation in Ireland can be achieved in two ways. Both parties can enter into a ‘Separation Agreement’ which, in essence, is a contract with your spouse setting out the agreed terms. The second method is a court process called a ‘Judicial (Court) Separation’. This Court process can involve a consent application where both parties have reached agreement, or on foot of a contentious process where agreement has not been possible.In either approach, the Dillon Family law team carefully listens to our clients, getting to understand their needs. Collaborative Law

Brendan Dillon is a trained Collaborative Lawyer and is a member of the South Dublin Collaborative Lawyers Group. Collaborative law is a process where the two parties to a relationship, with the assistance of their lawyers, seek to find solutions to the issues relating to their relationship breakdown in a non-adversarial context. This structured approach is designed to address all needs, particularly focusing on promoting the best interests of children. Through collaborative efforts between all parties, this method explores various settlement options. It has a particular emphasis on principled, dignified, and respectful negotiation while ensuring open and transparent communication with full disclosure of all important information.

Mediation

Mediation serves as a valuable tool for settling Family Law disputes, especially in cases involving children from the marriage. The emotional impact on children facing their parents’ separation is undoubtedly profound. By opting for our Mediation service in order to reduce conflict, parents can reach child-focused decisions, facilitating a smoother transition to co-parenting while living separately. Cohabitant Disputes

If an individual has been living with a partner in a non-marital relationship, and the relationship concludes, they may have a claim for redress. In this case, they must demonstrate that they are a qualified cohabitant. Co-habitant disputes can be complex and stressful. We can advise you if you or they qualify, and we can outline the factors that a court would consider in the event of considering a claim for redress.

Relocation Disputes

As a general rule, when an individual has a child with another person, and the other parent holds joint guardianship, they cannot remove the child from the jurisdiction. Engaging in such an action may lead to a child abduction claim by the other parent. In the event that a situation arises where one believes their spouse/partner has taken their child out of the jurisdiction, it is crucial to seek legal advice as soon as possible. We have experience in advising clients in Relocation Disputes and in successfully securing the return of the children.

Guardianship/Access

Guardianship relates to the rights and duties of parents in respect of the upbringing of their children. Guardianship can be obtained by consent of the parties or by court order. It includes a duty to maintain and properly care for the child and refers to the decisions that must be made during the lives of the child which relate to the general lifestyle and development of them.Custody is the right of a parent to exercise physical care and control in respect of upbringing of their child on a day to day basis.Access applications are determined by the court, prioritising the child’s best interests. We offer expert guidance on these often contentious family matters, addressing changes introduced by theChild and Family Relationships Act, 2015. This emphasises the importance of the child’s well-being and the inclusion of their voice in decision-making processes. Please note that Dillon Solicitors only deal with Circuit Court matters relating to Guardianship and Access.

Nullity

Nullity of marriage is a declaration by a court that a marriage is null and void, and that no valid marriage is deemed to exist. This differs from divorce in that a divorce is a declaration bringing a valid marriage to an end. Under the law of Nullity, there are two types of marriages that may be annulled i.e. “void” marriages and “voidable” marriages. A “void” marriage is treated as if it never occurred, often requiring a court order to clarify its status. For “voidable” marriages, the marriage is valid until a decree of annulment is obtained through an application by either party. We have extensive experience in advising on a number of cases in relation to applications for Nullity both in the Circuit Court and in the High Court.
