In a case brought under the Cohabitants Act, how is the two years being separate assessed ?

The Cohabitants Act is different from the Divorce Act.

In the Cohabitants Act, a period of reconciliation, if of any significance, will stop the clock running and if the reconciliation breaks down then it is likely that the two year period will commence again.

This was the decision of the Court in the case of  MW v SC, although it held that the couple can be living physically apart but still in an intimate and committed relationship.
